On Wednesday, April 6, 2022, at approximately 11:52 P.M., officers with the Colorado Springs Police Department (CSPD) Sand Creek Division were dispatched to a residence in the 1800 block of Whitman Road regarding a possible burglary in progress. When officers arrived in the area, they contacted the victim and learned that the suspect left the area prior to officers’ arrival. Officers were given a suspect description as well as a vehicle description including a partial license plate.
At approximately 11:55 P.M., officers were advised that the suspect had entered the residence again. Officers then responded code three, meaning lights and sirens were activated. As officers arrived back in the area, they observed the suspect vehicle fleeing the scene. At that time, officers attempted a traffic stop. The traffic stop was unsuccessful, and the vehicle fled from officers southbound on Circle Drive. After passing through the intersection of Monterey and Circle, the vehicle began driving south in the northbound lanes of Circle Drive at Monterey Road. Due to the suspect’s driving behavior, the officer terminated the pursuit.
Shortly after terminating the pursuit, officers advised they believed the suspect vehicle flipped over as it was using the northbound on-ramp as an off-ramp. Officers immediately responded to the area and found the suspect vehicle. According to the officers on scene, both the driver and the passenger of the vehicle were ejected. One of the people in the vehicle was located with life-threatening injuries and was treated on scene by CSFD and AMR prior to being transported to a local hospital for further treatment. The other individual was found and determined to be deceased on at the scene.
Due to the nature of this crash, the Major Crash Team was notified and responded to assume responsibility for the investigation of the fatal traffic crash. Speed is considered a factor in this investigation.
Preliminary investigative information suggests that the driver of the vehicle lost control and the car rolled over multiple times. It was also determined that the vehicle was driven by 34-year-old Kyle David Herschfield and 25-year-old Seth Walden was the passenger.
On April 7, 2022, the El Paso County Coroner’s office conducted an autopsy of the deceased person from the crash and identified him as Seth Walden. This is the 7th fatal crash this year. At this same time last year there 9 fatal crashes.
On 04/07/2022 Kyle David Herschfield was arrested and charged with Vehicular Homicide, 1st Degree Burglary, Menacing with a deadly weapon, Criminal Mischief and several other related charges.
